The short answer
Before signing a Colorado buyer representation agreement, ask who represents you, what services are included, how compensation works, how long the agreement lasts and how it can end. Read the actual terms rather than assuming a standard arrangement. Colorado’s August 12, 2026 advisory explains that written agreements establish both agency and transaction-broker relationships; a relationship disclosure is not a substitute for understanding your contract.
Which relationship are we establishing?
Ask whether the broker will act as your agent or as a transaction-broker and have the duties explained in plain language. Discuss what happens if the brokerage also has a connection to the seller. A disclosure may explain available relationships, while the signed agreement establishes the selected working arrangement and its terms. Keep copies of both.
What property and time period does it cover?
Review the beginning and ending dates, geographic scope and any property limitations. Ask whether the agreement covers new construction, properties you find yourself or homes outside the original search area. Do not rely on a verbal understanding that conflicts with the document. Narrow or clarify the scope before signing if necessary.
What compensation could I owe?
Identify the amount or method, when it is earned and when it is payable. Ask how seller or listing-broker contributions affect your obligation and what happens if those contributions are smaller than expected. Compensation is negotiable. A statement that someone else usually pays does not replace a clear explanation of your contractual responsibility.
How can the relationship end?
Read termination, extension and holdover provisions. Ask what notice is required and whether obligations may continue for particular properties after the agreement ends. If you are dissatisfied, understand the process before a dispute arises. Material uncertainty about legal consequences is a reason to obtain legal advice, not to sign first and investigate later.
What service should I expect?
Clarify touring arrangements, offer analysis, document review, deadline tracking and communication. Ask who provides backup coverage and how referrals to lenders or inspectors are handled. A useful agreement discussion connects the promised service with the written duties, so both sides understand how the relationship will work throughout the purchase.
If an explanation is important to your decision, ask where it appears in the agreement. That simple question connects the conversation with the document you will sign. Keep notes of unresolved questions and resolve them before committing rather than assuming a friendly discussion overrides a conflicting written provision.
Your decision checklist
- Identify the selected brokerage relationship.
- Read the dates and property scope.
- Clarify compensation from every source.
- Review termination and holdover terms.
- Keep the executed agreement and disclosures.
Common questions
Is the brokerage disclosure the same as representation?
No. A disclosure can explain relationships and duties, while the agreement establishes the working relationship and contractual terms. Review the documents by their function rather than treating every signature page as equivalent.
Can I negotiate the agreement?
Yes. Ask about changes to compensation, duration, scope or other terms before signing. Any agreed change should be properly documented. Do not assume an oral promise changes the written contract.
